When you interact with us, we collect data.
Sometimes you give it to us. For example, when you order a product, you tell us where to deliver it. Sometimes we collect it automatically. For example, through our use of cookies on our website, which we explain in more detail below.
We have written our Privacy & Cookies Policy to set out how we collect, hold, use and disclose that data. We also want you to know who to contact if you want to give us feedback on these issues.
Our policy applies whether you're interacting with us online, in stores or through our customer service team.
We are the Just Group. We own and operate seven retail brands in Australia and New Zealand. The brands are Dotti, Jacqui E, Jay Jays, Just Jeans, Peter Alexander, Portmans and Smiggle (Just Group brands). We also operate our Smiggle brand outside of Australia and New Zealand – specifically, in the UK, Ireland, Singapore and Malaysia. Because we have stores and websites in different countries, we have companies set up in each of the countries we operate in, including for the websites that we sell our products from. This policy applies to your dealings with the Just Group brands in Australia and New Zealand.
If you're buying things from our Australian website or visiting our Australian stores, then you are dealing with Just Group Limited ABN 97 096 911 140 (Just Group) whose registered office is at 457 St Kilda Road, Melbourne, Victoria 3004.
If you're buying things from our New Zealand website or visiting our stores in New Zealand, then you are dealing with Kimbyr Investments Limited (NZBN 9429040001807), whose registered address is 38 Sir Woolf Fisher Drive, Highbrook, Auckland, 2013, New Zealand.
This policy applies to the Just Group and all of its subsidiaries (we, our or us).
We know how important your personal information is to you. We are committed to safeguarding that information.
We will follow all the privacy and data protection laws that apply. This policy doesn't limit any of those laws.
You're in control. You can:
Sometimes your rights are subject to exceptions permitted by law, for example, where an access request might prejudice law enforcement activities. We'll give you reasons if we can't comply with a request. Please send any requests to our Privacy & Data Protection Officer (details below).
If you have any concerns about any aspect of our privacy practices, you can also report it to the relevant privacy or data protection supervisory authority in your country of residence, work, or the place of any alleged breach. In Australia, that's the Office of the Australian Information Commissioner (www.oaic.gov.au). In New Zealand, it's the Office of the Privacy Commissioner (www.privacy.org.nz).
Contact details: for example, your name, address, phone number and email address. We use this to update you on your order & fulfil it, send you emails about our products, for fraud prevention and detection, to show you our adverts as your browse the web or social media, and to find out more about what you and other customers like.
Transaction information: we use this to take payments, give refunds and for fraud prevention and detection (don't worry, we don't keep your payment details).
Order history: we use this to perform our contract with you so you can purchase products from us, so that our customer service team members can provide you with support and assist with returns and refunds, and so that we can find out what you and other customers like to make sure we are providing you with the best possible shopping experience. It also helps us anticipate demand and to keep up with it.
Competition entry info: we use this so you can participate in promotions and competitions, including contacting all our lucky prize winners.
How you use our site: we use this to give you a better shopping experience overall.
Your communication and marketing preferences: we use this information to make sure we are only sending marketing communications that we are legally able to.
Your location: we use this to offer you a better shopping experience, depending on where you live.
Your interests, preferences, feedback and survey responses: we use this to give you a better shopping experience, for our internal market research purposes and to deliver targeted advertising to you based on those interests.
CCTV and your image: in some of our higher risk stores we use CCTV camera for crime and theft prevention. If you visit these stores your image may be captured. You'll know which stores this applies to as it will be clearly signed. The cameras will be clearly visible and will only be placed in public areas.
Member info as part of a loyalty program: if you join one of our loyalty programs (for example, Just Shop Rewards™ or the Smiggle VIP program), we may collect additional types of information from you to help us administer the program, and rewards granted to you as a member. More information can be found on our website at one of the loyalty-related links below.
This list is not necessarily complete. Sometimes we may need to collect additional information for one or more of the purposes set out in this policy.
If you don't want to give us your personal information or you want to remain anonymous, that's okay too. But this may restrict our ability to provide you with our services or access to certain features on our websites. For example, you can check out as a guest without creating an account or signing up to our database, but we still collect certain personal details from you to fulfil & deliver your order.
Privacy and data protection laws require us to have a lawful purpose for collecting and using your data. This is sometimes described as a "legal basis" and it means that we can only collect your information by fair and lawful means. Here are the reasons why:
Consent. We can collect and process your information with your consent and for a specific purpose. For example, when you opt in to receive marketing communications from us. You might do this directly from our website, or you might sign-up in store. You can always change your mind. All our emails have an unsubscribe option, or you can also contact us to stop receiving them.
Contract. In certain circumstances, we need your personal information to comply with a contract we have with you (or if we've asked you to take a particular step before entering into that contract). For example, ordering from us is a contract you have with us.
Legitimate interest. This is where processing your data is needed for our legitimate interests or those of a third party, provided those interests aren't outweighed by yours. Our legitimate interests include improving our service, determining whether marketing campaigns are effective and enabling us to enhance our business. For example, we sometimes combine the purchase history of our customers to identify trends and make sure we can keep up with demand.
Legal compliance. Sometimes we're required by law to collect and process your information. For example, where we pass on details of people involved in fraud or criminal activity to the police (such as anything captured on CCTV); or where we might be required to pass on information about a product recall.
We use cookies on our website.
Cookies are small pieces of information stored by your browser on your computer or mobile device. Cookies are used to maintain session information between your browser and our website and identify things related to your use of the website such as the time, date and URL of the pages you visit, your IP address, your location and browser software. Some computers and mobile devices also permit your location to be shared with us (often referred to as geo-location data).
Most browsers can notify you when a new cookie is received, or let you turn off cookies or geo-location services altogether. Turning off these services or not agreeing for us to use cookies may mean some features on our website are not available to you.
We use information obtained this way in order to learn about your preferences so that we may improve our website and the service offered through it.
We use two different types of cookie – session cookies and persistent cookies. A session cookie is stored temporarily. In other words it only lasts until you close your browser. A persistent cookie is stored on your device. That means it lasts until you or your browser deletes it. For example, we may use cookies to store your preferences so you don't have to set them up every time you visit our website.
You might also see web banner advertising while browsing other websites related to products you've viewed on our website. We place these ads using cookies. Some of the cookies we use are associated with your account (including personal information about your logged in status, your location, email address you gave us), and other cookies are not. We use both first party and third-party cookies. First party cookies are those which we use. Third party cookies don't originate from us. Social networking sites use third party cookies so you should check the websites of those networks for more information about managing their cookies.
Cookies let you log in and out of your account.
Cookies are just one way we protect you from security risks. For example, we use ShieldSquare to detect when someone might be trying to hack your account.
We use cookies to help us show you products you are likely to be interested in.
Examples of the cookies we use include:
We use cookies to help us deliver relevant digital advertising.
Examples of the cookies we use include:
We use cookies to make our services better. For example, these cookies tell us how many customers use a certain feature and how popular it is, or whether people open an email we send.
We also use cookies to help understand who sees and interacts with our ads, and who visits our website or purchases our products after clicking on an ad.
Sometimes we hire security vendors or use third-party analytics providers to help us understand how people are using our services. Just like we do, these providers may use cookies.
Examples of the cookies we use include:
You can accept or refuse the use of cookies. However, refusing, blocking and deleting cookies may mean that you won't be able to access or use all of the features of our website. The methods to block, reject and delete cookies will vary from browser to browser - for more information visit www.allaboutcookies.org.
We use carefully selected third parties in certain parts of our business. The relevant organisations include those:
Like we said at the start, we have stores all over the world, which may involve transferring your information back to the Just Group whose global head office is in Australia.
We also use some third parties to administer part of our service delivery, so some of the uses and disclosures may occur outside of your country of residence. This means that sometimes we'll need to transfer your personal information between countries and in particular to Australia (where our central database is operated).
By submitting your personal data, you agree to this transfer, storage and processing. Despite this, be assured that we will take reasonable steps to protect your data and prevent any third parties outside of your country of residence using your personal data in any way that's not set out in this policy.
Your information is stored securely whether in an electronic or physical form. We take all reasonable steps to protect all personal information from misuse, loss, interference, unauthorised access, modification or disclosure. If you transact with us online, make sure you keep your account details secure and contact us if you think you're account has been accessed or your privacy rights have been breached.
We'll hold on to your personal information only for as long as is necessary for the purpose we collected it or where we have a legitimate interest to continue doing so. Sometimes we are required by legal or regulatory requirements to keep hold of some of your information even after you have closed your account with us. This may be to resolve disputes, prevent fraud, tell you about a product safety issue or to apply our terms and conditions.
We acknowledge and support the importance of children's privacy and safety. We do not knowingly collect personal information from children under 16.
If you become aware that a child under 16 has provided us with personal data without parental consent, please contact us through our Privacy & Data Protection Officer whose details are set below. If we become aware that a child under 16 has provided us with personal information without parental consent, we will attempt to delete this information as soon as possible.
Sometimes we will need to update this policy, for example to explain a new process or to comply with new laws. The last time we changed the policy was on 21 March 2023. If we update the policy, we'll put a new one on our website.
Want to know more, or to exercise any your rights set out in this policy? The best way is to contact our Privacy & Data Protection Officer by email at privacyofficer@jjh.com.au.
If you have a customer service question that's unrelated to privacy, please go back to our home page and check out our contact details under 'Contact us'.
